In a unanimous decision, the three-judge panel sided with a group of Republican-governed states, including Texas, Alaska, Arkansas, Kansas, Louisiana, Oklahoma, and West Virginia, which contended that the plan was bypassing Congress and violating federal statutes.
The Biden administration had initiated the plan, known as the Remain in Mexico policy, in reaction to a surge in migrant arrivals last year. The policy aimed at addressing the crisis by allowing U.S. Customs and Border Patrol (CBP) agents to send applicants for asylum to Mexico before their cases are heard.
