North Dakota Judge Strikes Down State’s Abortion Ban

In a significant ruling, a North Dakota judge has struck down the state’s abortion ban, citing that it is unconstitutional. The ban, which was signed into law in 2013, prohibited abortion after a fetal heartbeat is detected, which can occur as early as six weeks into pregnancy.

Judge Dan Hovland, a Republican, ruled that the ban violates the state’s constitution and the US Constitution’s guarantee of a woman’s right to privacy. The ruling comes after a lawsuit was filed by the American Civil Liberties Union (ACLU) and the Center for Reproductive Rights on behalf of a Red River Women’s Clinic in Fargo, which is the only abortion clinic in the state.

The judge’s decision is a major victory for abortion rights advocates, who have been fighting against the ban for years. The ruling is also a significant setback for anti-abortion groups, who had argued that the ban was necessary to protect the rights of the unborn.

The North Dakota ban was one of several abortion restrictions passed in recent years by states across the country. While the ban was blocked by a federal judge in 2015, it remained in effect until the latest ruling.

The ACLU and the Center for Reproductive Rights hailed the judge’s decision, saying it was a major victory for women’s rights.

"This ruling is a huge win for the women of North Dakota and a major setback for politicians who have tried to control women’s bodies," said Jennifer Dalven, the ACLU’s Reproductive Freedom Project director. "We will continue to fight to protect access to safe and legal abortion in North Dakota and across the country."

The Center for Reproductive Rights also praised the ruling, saying it was a major victory for reproductive rights.

"This ruling is a huge victory for the women of North Dakota and a major setback for politicians who have tried to control women’s bodies," said Nancy Northup, the Center for Reproductive Rights’ president. "We will continue to fight to protect access to safe and legal abortion in North Dakota and across the country."

The ruling is likely to be appealed by anti-abortion groups, who argue that the ban is necessary to protect the rights of the unborn.
