First of all, you all don't know how much this group helped us during all our research and this process. I hesitated for a moment about posting this, but I remember when I was looking for information and all your post help me be more prepared, so this might help one of you. Thanks!
We got married in Nov/2023 and we started working on gathering all the evidence, and it wasn't until March that we got with our Lawyer and started the process. Everything was ready to be sent to USCIS and the Lawyer sent all the documents on March 23.
It showed received on March 27th, but we didn't receive the Receipt #s until April 4th.
Timeline:
- Came to US in Nov 2019 on Tourist Visa
- Married partner November 2023
- Sent I-130, I-485, I-765 and I-131 on March 23/2024
- USICS received Forms March 27
- I-765 Approved May 30
- I-765 Card received Jun 14
- Chat thru EMMA to see where my case was (I-130 and I-485), they mentioned it was move to Memphis FO
- I-130 on Jun 28, case move to "Actively Reviewing"
- I-130 Approved July 1
- I-485 Denied July 18 – Denial notice letter mentioned that the case was actually on "Administrative Closed" because Wife had an Open Asylum case with Court Date in 2025 and they (USCIS) didn't have jurisdiction. If for whatever reason we were able to close that case, we could send a letter back to the FO with Evidence of the dismissal Asylum Case to Reopen the case (I-485)
- July 19 – We got with the Lawyer, and she sent a letter to the Court (EOIR) with the I-130 approval for them to dismiss the Asylum Case.
- August 5 – Lawyer received dismissal of Asylum Case and sent documents back to FO for them to Re-Open I-485 Case. (I-485 Denial Notice, I-130 Approval Notice, EOIR Dismissal Asylum Case Documents)
- I kept waiting after that for a notification from USCIS opening the case, not even a notification from them receiving the documents back from my lawyer, nothing for a Month and a Half.
- I-131 Denied August 29 – Because the I-485 was still showing "Denied" or "Administrative Closed"
- I-485 Approved September 14!! – When I got the message of "Action taken in your case" I was expecting the news of them Re Opening the case but to our surprise it was already Approved!
- I-485 Card Received September 23
