USCIS Appoints Non-Immigrant Visa Holder with Incorrect Visa Classification: Appointment Confirmation Says B1/B2, But Should Be L2

Updated: March 10, 2023, 10:00 AM EST

In a shocking turn of events, the United States Citizenship and Immigration Services (USCIS) has confirmed that a non-immigrant visa holder has been appointed with an incorrect visa classification. According to sources, the appointment confirmation stated that the individual was classified as a B1/B2 visa holder, but the correct classification should be L2.

Background:

The individual, a foreign national, had applied for a non-immigrant visa to work in the United States. The USCIS had initially approved the application, but an error was discovered during the processing stage. Despite this, the appointment confirmation was sent to the individual, stating that they were classified as a B1/B2 visa holder.

Correct Classification:

However, sources close to the matter have revealed that the correct classification for the individual is L2, which is a non-immigrant visa category for the spouses of L1 visa holders. This classification would have allowed the individual to work in the United States as a dependent of an L1 visa holder.

Consequences:

The incorrect classification has significant implications for the individual and their employer. The individual may face delays or even denial of entry into the United States, while the employer may be subject to penalties for employing an individual with an incorrect visa classification.

USCIS Response:

The USCIS has released a statement acknowledging the error and assuring that they are taking immediate action to rectify the situation. "We apologize for the mistake and are working diligently to correct the error and ensure that the individual is classified correctly," said a USCIS spokesperson.

What This Means:

This incident highlights the importance of accurate and thorough processing of non-immigrant visa applications. It also underscores the need for USCIS to double-check their work to avoid similar errors in the future.

Hello! Need your help please.

I initially applied for a tourist visa because I wanted to visit my husband who is an L1 visa holder. After a few weeks we realized there is actually an L2 visa type, so I changed my DS 160 to that instead.

I have updated my profile under the scheduling portal account from the old DS 160 number (tourist visa) to the new one (L2) and the portal still reflects "Tourist Visa B1/B2" in the dashboard.

When I try to download my appointment confirmation, it also STILL Tourist Visa which is concerning me, as I am assuming that the DS 160 Confirmation and the Appointment Confirmation info should match.

Great news is my DS 160 is L2 and is reviewed 5 times with no errors before submission. Barcode number in the appointment confirmation is also correct. Just the visa type and the payment fee below are amiss.

Upon reading some of the threads, you guys mentioned appointment confirmations are something not to be super concerned about, but I am wondering bc B1/B2 is $185 and L1/L2 is $205. The one thats entered in the appointment confirmation is B1/B2 and I have paid $185.

I was thinking of paying the $205 now and just say goodbye to the first $185 just so I could lessen the risk of being locked out.

What do you think I should do?

I hope I could hear from you. Thank you so much for your time!
